I just found this MEMO it seems that as of april 1st 2008 the Montana Board of Realty Regulations is Permiting Real Estate Brokers to offer Rebates to Consumers. This after last fall when we were given a memo from the State Realtors attorney saying that buyers rebates were illegal and that a new law was being created to make it even more clear that it was illegal. This MeMo even Suggested that Cash Back was Mortgage Fraud. Which is NOT true and Now this Memo. Click HERE.

Barnett, Assistant Attorney General in charge of the Department’s Antitrust Division. “As we have consistently seen in other states, the repeal of rebate bans lead to increased competition between brokers and lower prices for consumers of real estate brokerage services.”
