The Tobacco Valley News gets invited to all political meeting, the Tobacco Valley News gets weekly information from the Eureka Police, and the Tobacco Valley News gets the Police Blotter information, but the Tobacco Valley News only tells you a small part of the story. The Tobacco Valley News only gives you the version of REALITY, of the “news” that they want you to know or to believe.

Well, when you have one paper in town, they get to decide what is the Real News. The Tobacco Valley News gets to control the flow of information to you. What you know about crime, animal abuse, sexual assault, beatings, robberies, crimes against children, and other major issues that affect you, this information is withhold by your local newspaper, Why?

Now the City of Eureka tells the Tobacco Valley News what they can, and yes some stuff is confidential, however most information that flows to the Tobacco Valley News from local law and “secret meetings” that Steve Newman of the Tobacco Valley News is NOT told to you. So you think what ever information you can pick up from the rumor mill, your friends and the TVN is really what is going on.

The Tobacco Valley News Does not want you to know the Truth. I am not sure what they are afraid of. I know for sure that Ad Dollars is one reason, but I am not so naive as to think that ad dollars are the only reasons.


Don’t you deserve to know what is really going on in your Community?

Over the years there have been horrific crimes that you don’t know about, why don’t you know? Who gets to keep that from You? I guess the powers that be don’t feel that you are intelligent enough to handle the truth. If you knew the Truth then you might have been able to prevent the same crimes happening and worse.

Getting Rid of the Libby Police Department - What is the Real Motive for This ?

What is the Real Motive of Getting Rid of the Libby Police Department and Who Decides that this is what is best for the County and the City of Libby?

Without the Libby Police Department would there be more money for the County Law enforcement and for the Commissioners ?

As far as I am concerned, the Lincoln County Cops cannot protect and serve Eureka, are in no way policing Trego or the West Kootenai and do not have time to take over the Libby City Cops Duties. You tax paying citizens in Lincoln County need to really look hard at this and ask why the County wants to do this, and at a time where it is Blatantly obvious that we need more law and not less law.

What is The Motive? Does the Sheriff have issue with the City Cops ? Is it a Budget Issue?

Near a Million Dollars a Month your county spends and Eureka Does not get anywhere near that to run. Where does all your Tax Dollars really go.

The Eureka Cops will do what they can but guess what, there is not a whole lot in City Limits and the County is Not Really here in a way that we can count on.

You can ignore all this stuff, it has worked this long and hey it is not happening to you right? But it is happening to you, your Commissioners you County Officials affect you, they decide what jobs you get (based on incentives the county gets - in my OPINION). Your taxes are affected by the decisions that are made for you, while you are left in the dark.

Now that it has come to NW Montana with the Daily Interlake article today about the FBI in lolo Montana on this matter, I must say that it is shocking to put this kind of Federal Man Power into stopping people who want to die, but no man power in Mortgage Fraud that affects people daily, no Man Power in Rape and Robberies and local crimes that are so bad it makes us all cringe... but the FBI is here to STOP assisted suicide in cases of people dying of horrible disease that are making personal choices.

9th Circuit lifts ban on witnesses - W.R. Grace Trial Montana


A three judge appellate panel Friday overturned a ruling by the judge in the W.R. Grace trial,
who said 34 asbestos exposure victims on the federal prosecutors’ list of witnesses would
not be allowed in court except to testify.

In his Feb. 13 pretrial ruling, U.S. District Judge Donald Molloy said the 34 witnesses, identified by the federal government as victims of asbestos contamination, do not meet the meaning of “crime victim” in the Crime Victims’ Rights Act. He excluded them from court proceedings. Three appellate judges of the 9th U.S. Circuit Court of Appeals overturned that general prohibition Friday and ordered Molloy to make “particularized findings with respect to each of the 34 victim-witnesses.” The order came in response to a petition by federal prosecutors seeking to overturn Molloy’s ruling. Grace and five former company officials are on trial for federal environmental crimes. The trial resumes Monday when Paul Peronard, the environmental Protection Agency’s on-scene coordinator in Libby, is expected to resume his testimony. Peronard testified Thursday that employees of W.R.

Did W.R. Grace Obstruct Clean Up Efforts ?


W.R. Grace and Company seems to have misled the government and obstructed efforts to clean up the Libby Asbestos mine site in Montana.
(Shocking ? Not Really)


Apparently Paul Peronard testified on Thursday at the federal environmental crimes trial going on in Missoula with W.R. Grace and five of W.R. Grace's former company officials.

Paul Peronard was EPA’s on scene coordinator in Libby, Montana where Grace operated a vermiculite mine.

Paul Peronard said Grace officials provided him false and misleading statements during the initial phase of the Libby Mine cleanup, at that time the EPA was trying to gauge the scope of asbestos contamination in Libby.

Paul said he helped arrange sale of the mine site back to Grace, so that the EPA could use it as a repository for asbestos-contaminated mine waste. He said that, one day after the sale was completed, Grace denied EPA access to the site. This is not out of character for W.R. Grace in my opinion. Grace Lies and the State of Montana backs them up, well that is what it seems like to me, a Lincoln County Resident.

Paul Peronard said “It just threw a wrench in all the operations we had planned,” Peronard testified that he had asked former mine manager Alan Stringer about the vermiculite concentrate at the various mine sites, and he was told the material contained less than 1 percent asbestos and was not hazardous. Company documents would later reveal that Grace’s own product testing showed even low levels of asbestos caused dangerous releases of airborne fibers. ( this stuff so reminds me of Erin Brockovich). Lies, Coverup, Connections to "Corporate". Knowing what they were doing to Libby Montana Residents but not caring and not being made to care by the State of Montana. ( Hey it's Revenue, who Cares Right?)

W.R. Grace told the EPA that it never provided asbestos-contaminated vermiculite to the general public; but Peronard said he would later learn that Grace provided vermiculite for the junior high school running track and the Plummer Elementary School skating rink in Libby.

It is so funny to me that Grace even tried this one, we all know that our families played in piles of vermiculite (asbestos) at school, it is common knowledge in Lincoln County.


Community residents also have said that Grace provided vermiculite to the general public for a variety of uses, such as gardening. Peronard testified Thursday that, by misleading the EPA about the scope of the contamination, the company delayed emergency response to homes and the general community, putting crews “in a big circle.”

Gardens, Schools, Homes, on the Clothes of Workers, in the Air, you could not get away from it and Grace knew how bad it was and ignored it, as did, in my opinion the State of Montana, but the State of Montana Reaped the Rewards of a Poisoned Community, in my Opinion.

The Damage that W.R. Grace has done to Lincoln County is irrepairable, the best folks can hope for is enough money to move on. Not to mention what they did that haunts Libby Still today and does affect property values and people moving into the area.

Montana Court System Smackdown -WR Grace Trial FINALLY going on in Missoula and it is NOT going Well, Surprise !!!

Those of you watching the WR Grace Trial know that Montana Courts are making the victims look confused and ignornant, just as in the Wilderness Club Case. The Big Corporation will win, it is the Montana Way. Now Libby Residents have suffered decades and in one sweep the Montana Court System has made all this suffering look within the law, and you can't make WR Grace pay for a law that did not exist when the mine started, even though their is still asbestos in the air today. I mean wasn't there an air quality test in the last year that presented problems?

Houses are still being mitigated, a Town Left to Die. And now when there is a chance to help the victims and the Lincoln County Residents the courts make them look wrong, look like their disease could have been caused by anything, and set the stage for WR Grace to Exit Freely and without harm.

As a Life Long Resident of Lincoln County Montana, having relative who have asbestosis and relatives who have died from it (a long painful death). And seeing what is happening in court to Lincoln Residents who are innocent and Crimes have really been committed against them, I see a County in serious trouble and a State that protects the party with the most money.

Either Lincoln County Montana has a different set of rules or State Law needs a makeover. I have been told, and more on this later, that Montana Law defines a Victim differently then federal law, and this is not right. You see in the WR case court information that those hurt by all of this are NOT allowed to be called Victims, that is what they are in the United States, but not in Montana. So ask more questions folk, learn more about the laws of your state, and in your homes across Montana think about why WR Grace has been treated as they have, why big companies such as the Wilderness Club here in Eureka can do what ever they want - regardless of laws and court orders.. Why Is This ?

Years and Years of Fighting, dying, pain, can’t breath on their own only to get the Montana Court System smack down. Folks talk to EVERYONE, ask around, the way courts seem to work in Montana, Victims rights, not being able to call a victim a victim until the courts say so, these kinds of things are not federal law but the way the State of Montana treats victims, that are not allowed ANY victims rights because they are not a victim until there is a crime.

The State of Montana got money for the suffering of the victims right? It is called cleanup, but Montana will let Libby suffer and die in vain. While the State got hundreds of Millions (links on this are below) The State of Montana, in all it’s wisdom let WR Grace come in and do this to the people, they said all was well and ya know what Montana is still doing that today. Lincoln County has mines right now that get brought up on safety issues, get DEQ fines and claim they are safe, and at they same time they want to drill under the Cabinet Mountains, it is very shocking. The State of Montana has no respect for it’s tax paying citizens.

The State of Montana Let it Happen.

The State of Montana got the Clean up Jobs.

The State of Montana Got a Huge Sum of Money.

If Montana State Courts do not believe you really suffered or that the criminal committed a real crime then YOU Lose !! Wilderness Club Resort -

Years of Hell, your Trees Stolen, your Rights run over, a BIG Corporation defy's a judges orders to STOP building a commercial building that not only violates local covenants but is RUINING the quiet enjoyment of the neighbors with 24 hour lights, LOUD generators, noisy truck (deliberatly being louder then necessary), and constant harrassment.

The Wilderness Club resort in Eureka Montana ruined the life of neighboring property owners, a whole lot of nasty stuff happened and to bad there was not a video in the neighboring home or their would be no way to accuse the McKays of lying or fabricating. The Wilderness Club did everything they are being accused of, they ruined these peoples lives and because they are politically connected and now with all our mills out of business the Wilderness Club Golf Resort in Eureka Montana is the biggest thing we go goin' .

Now District Court, a Jury of their peers awarded the McKay family 1.3 million dollars. I think that it was 1 million punative and $300,000 for their home's value loss. The judge went against that, awarding $25,000 punative and the $300,000 for the house. Of course the Wilderness Club Resort appealed the money for the house. So I ask, why have a Jury Trial at all, this trial was only for punative, for loss of value. The Jury spoke, and they got a smack down. SO why bother having a jury trial at all ? Is it a federal regulation ? I mean if the judge does not like what the jury says and can reverse the jury's decision why not let the jury stay at home with their families or stay at their jobs?

Was the Real Estate value get affected by what the wilderness club did to this family? You bet it was, the Wilderness Club Montana ruined this property and these peoples lives and your Montana Justice system could care less. Now in Montana, so I am told, there is NO Victim unless it is proven there is a crime, so are the McKay's Victims in all this, probably not in Montana.

The Wilderness Club certainly did act with malice and they defied a court order and kept building when ordered to STOP. But hey you are in Lincoln County, You are in Montana and here that seems to be rewarded if you are a big company like the Wilderness Club Resort in Eureka Montana.

Those of us in the KNOW on this one, will NEVER forgive the Wilderness Club for what they did to the McKay family. We were there all along, we know what is true and the McKay's are NOT lying, not fabricating, THEY speak the truth.

Nick Faldo, Norcal Group, Hart Howerton, Faldo Design, and Schmidt-Curley Design got to get that money rolling in. I mean, money is the only reason for Lincoln County to exist right?

These peoples lives were hurt and for years, and the Wilderness Club LLC gets to just go on as if all is well and they did nothing wrong. Long time, tax paying residents of Lincoln County Montana and this is what they get. NEW money, big money, celebrity golf pro, and local muckity mucks win over you Common Folks rights every time, it's the Lincoln County Way.

Your Land could be next, Forced Easements, old county roads opened up for big money developers, big money corporations will soon move in next to you and you can bet that your county - your court system will pick them over you because of the magic green paper - MONEY.

Why Does Child Services Ignore Lincoln County Montana - Warning - Graphic Content...

Ignoring the Cries of the Young in Lincoln County is Not New by Far.

What seems to actually be new is that a few have the courage to stand up for these folks that we are not legally allowed to call victims and that these folks have the courage to speak out - to stand up for them at all. r

My Blog is about current events here in Eureka Montana, but it also reeks of history of decades of ignoring those crying out for help. And I must admit, it certainly is something I too would rather ignore, but I simply cannot.

If you follow my blogs you know that I have written on a 4 year battle to get a young man out of a Meth house in Lincoln County Montana. Family would call me concerned, though I had already been fighting for years. I finally got enough family from all over the United States to stand up and be counted on this and to help me save this then 11 year old boy.

But the Montana Justice System Smack Down put an End to that.

I have fought for him such the age of 8 and he is now a product of a County that does not care enough for their children to do anything about it. Now, it is reported to me that he too Is and has been using illegal drugs for quite some time. I have reached out to State agencies, local agencies, detectives, and no one has the power or the courage to do anything that really matters. Everyone passes the buck. I sent emails to State Agency after State agency and all was sent back to Libby to Handle and Bad got Worse and I lost the battle, the Stake a young mans life.

I want to share with you part of an email sent to me, of a young woman who suffered starting at age 12 here in the Eureka Montana area, the school, peers, the state, teachers, and the powers that be in Lincoln County, in Montana either could not or would not do anything about it….

(… At seven my mother announced that we were moving from ...... to Montana. Her and her boyfriend had bought land in Trego up Butcher Creek. As soon as we got there, things began to change. We were isolated from society and with no phone, electricity, or any means of modern technology, there was no hope for help. My step father started becoming very violent.

He was obsessed with the fact that girls should be trained to be the perfect wives. I had a cot set up in the kitchen, where we only had a dirt floor for me to lay on. Although a bedroom had been built for me, my step father wanted to pound the fact that the kitchen is where girls belong into my head at a young age. He made it clear to us children that children are to be seen, never heard and that a woman should never speak unless spoken to.

If I were to talk at all, I would be severely beaten. I had found a few books in my step brothers belongings and found my refuge in reading them. When my step father found out, the books were burned bc no girl should have her head in the clouds with books when she should be cooking and cleaning.

When I was ten my step father had convinced himself I was fat and that I should go on a diet. His idea of a diet was to cut my calories down to 300 calories a day and I was forced to run ten miles a day with little nutrition to keep my energy up. He would enroll me into school for a few weeks for show, and then pull me out bc yet another bruise would show up, my hair was falling out from malnutrition, and people would start talking. It was like this every year.

I would be allowed to go to school for up to a month and then be pulled out. During one of those months, the teacher had told my mother and step father I desperately needed glasses. I remember my step father making me read the letters on a paint can to prove I was only looking for attention and could see just fine. Of course, i could not read the letters. Every time I said I could not see the letters, he would beat me. By beating, I do not mean spanking, I mean punching, kicking, etc.

Finally he beat me unconscious. When I awoke he had me stand up and try again. This time my older brother whispered what it said into my ear so he would not have to see me get beaten again.My step father had started raping me when I was ten. I just recently found out that my little sister had also fallen victim to his. She is five years younger than me. At this point, I found my refuge in my black lab. I would sneak out in the middle of the night and sit with him, planning our escape, knowing there was no escape.

When my step father found out of this, he slaughtered my dog. When I was eleven during the short periods I was allowed into school, I told a classmate what was going on. She assured me that she would talk to her mom and get me and my siblings out of there. DFS was contacted but they never talked to any of us children, they never came up to the cabin on Butcher Creek, they only talked to my mother and while she lied through her teeth, they chose to believe her and never did a true investigation.

Everyone in Trego knew what was going on and while I received pitying looks whenever I was allowed to venture into town, no one ever tried to help or to step up for what is right bc they all had the pioneer attitude to mind their own business. We finally escaped his clutches when I was twelve and I have not seen him since except in my nightmares. I suffer from sever PTSD and still cannot quite cope with everything. I omitted the worse of what happened up there bc just writing what I have thus far has caused me tears of pain and I don't want to dig too deep into memories I have tried for long to bury.

You can see where I am upset with the child abuse that is over looked there.... It's disgusting how many people could have stepped up.

It's awful that there is no one to turn to there. I left Eureka because I didn't want my children to grow up with the lack of values that are far too frequent there, and I didn't want them to think that the things that go on there happen in the rest of the world. I am always flabbergastered by the fact that people there think that their day to day life and fears are 'normal'.

So we do know that it is nothing new that Montana, the State of Montana ignores the please of Child Abuse Victims in Eureka Montana. You folks who follow my blogs have read my stuff before on spending 4 years trying to get a child out of a Meth home in Libby Montana. Once you call State Services they turn the Issue over to child services in Libby Montana and NOTHING is done about it.

I called over and over and NOTHING. Even after a dozen family member made distress calls to the Montana Child Abusive services and Hotline, Nothing was done, also after this the boy was allowed to home school in this Meth house, being with meth users all day everyday.

No One Cared enough to stand up, to do the right thing. I worked with social services, they said I had no legal right to know how the follow up went. I talked with detectives, I gave Names and NOTHING. No one came to the rescue with all the proof and evidence given to them, and a boy caught in the middle with no hope.

The Schools can’t or won’t do anything. Now I have met some fabulous teachers here so I suspect that they too are up against a brick wall. How do you support the victims of child abuse in Lincoln County Montana, be it sexual abuse, beatings, meth, severe beatings, or other? No One is Listening, No One is Held Accountable and there is no proof of follow through and you who do care, are NOT allowed to ask.

Who ignores their pleas for help? Who tries to help but has no State agency or outreach to truly back them up? I reached out endlessly and there was nothing I nor aunts, uncles, cousins, grandparents could do.

Libby natives prepare and reflect with W.R. Grace trial set to begin

University of Montana senior Danielle Bundrock remembers digging through piles of dirt in Libby as a child looking for what she called “gold nuggets” made of a shiny mineral called vermiculite that lay at the economic heart of her small mining community.

The mineral was mined in Libby and shipped around the country to make insulation for houses; it was fertilizer for gardens; it was the foundation of her favorite playground. It was in their baseball mounds, the high school track and the attics and walls of hundreds of homes in Libby.
It was everywhere; but her gold rush didn’t last long.

She soon learned some microscopic fibers from her precious stones were airborne and lodging themselves like small spears in the lungs of the people of Libby. Her nuggets carried tremolite-asbestos, the cause of asbestosis — a fatal, irreversible respiratory disease. Asbestos has killed about 300 people in Libby according to information from Libby’s Center for Asbestos Related Disease given to PBS in 2007.

Fourteen members of Bundrock’s family have been diagnosed with the disease.
W.R. Grace & Co., the company that owned and operated Libby’s mine, is now facing criminal charges of knowingly endangering lives by hiding the health risks of asbestos.

The trial, the U.S government v. W.R. Grace & Co., begins Monday in Missoula’s U.S. District Court and is being called the most extensive environmental criminal trial in U.S. history. Jury selection began Thursday for the high-profile case that’s been attracting national media attention. Five of Grace’s top executives and managers will face criminal charges in the trial.
Regardless, Bundrock said that even with a guilty verdict, she is doubtful that any amount of retribution could be enough.

Her grandfather and great-uncle worked at Libby’s mine before it was shut down in 1990, and after work they brought the contaminated mine dust home on their clothes.

“I think they were aware of the fact that it was harmful, but they didn’t know the extent, and they sure as hell didn’t know they were taking it home to their wives and children,” Bundrock said. “That’s the part that really killed them.”

The other 12 diagnosed members of Bundrock’s family never worked at the mine.
Her great-uncle Art and grandfather Don both died from asbestosis. Art worked at the mine for 20 years, Don for almost 10 in the 1950s and ’60s.

Despite her family’s tragedy, Bundrock said she never wants to leave Libby — even with the deadly dust. However, she is concerned for her generation, those from her town who are still too young to see the effects of it in their lungs.

“Even if they (those diagnosed with asbestosis) do get some compensation (from Grace), first off – what’s enough?” Bundrock said. “Then, just because that first generation gets compensation, that does nothing for the next generation that hasn’t been diagnosed yet. That’s a whole other issue that it seems they are just trying to sweep under the rug.”

There are 120 students from Lincoln County at UM — most from Libby, Troy and Eureka — according to data from the registrar’s office. Bundrock’s question is also on many of these students’ minds as the trial date approaches.

Cameron Rasmusson, a UM senior from Libby, said the trial has been a common topic of discussion among his roommates who are also from the town.

“In light of the upcoming trial, there is a shared sense of interest or curiosity in that this was something that was a pretty major part of that particular era in our lives, and now it seems to be coming to some kind of climax,” Rasmusson said. “I think there is a shared sense of personal drama in that sense.” ....

The Libby School District’s class sizes have dropped by about 40 percent of what they were in 1990 when few people were aware of the health effects of asbestos. It seems that the “death valley” stigma is still a concern. Families appear to be moving out – not in.

“It’s definitely hurting the population,” said Mike Decker, a UM junior from Libby. “From seventh grade to my junior year, the high school dropped by 250 students or so. It’s drastically changing the town. It’s becoming more of a retirement town than anything.”

Despite the hardships, Bundrock said she believes Libby is up for the challenge of rising from the ashes.

“Libby isn’t a horrible place filled with gloom and death,” she said. “It’s a horrible situation, but there are wonderful things going on there and it’s a great place.”

WR Grace - Bankruptcy - Victims Rights (another Montana Oxymoron)

As you Read This, Keep in Mind what the State of Montana Defines as a Victim (much more on this later, it seems Montana Law defines victim differently then the Federal Law, wel will be discussing that in great detail at a later date). So there is not a Victim if there is no crime... the crime has to first be determined by the Local and State Judicial System, the Courts, that it "really happened" and once there is a crime then and only then is there a victim.

Grace Poisoning Prosecution May Disrupt Bankruptcy

Feb. 19 (Bloomberg) -- W.R. Grace & Co., the bankrupt chemical and construction-materials maker, faces a criminal trial for allegedly contaminating a Montana town in a case that may disrupt a reorganization plan that’s taken eight years to craft.

The 155-year-old company and six of its former executives are charged in connection with the asbestos contamination of Libby, a town with a population of about 2,500 where Grace mined and processed asbestos-tainted vermiculite until 1990. About 1,200 people in and around the town died or were sickened, the U.S. Department of Justice alleged.

If convicted by a jury to be selected beginning today in a Missoula federal courtroom, Grace may be fined $280 million or more, the company said in a securities filing. Such a fine may threaten its proposed $2.4 billion trust for people injured by asbestos, a fund at the heart of Grace’s reorganization plan.

“A large enough fine would upset any Chapter 11 plan because it is going to mean dollars out the door,” said bankruptcy attorney Evan Flaschen, with Bracewell & Giuliani LLP, who isn’t involved in the case.

Greg Euston, a spokesman for Columbia, Maryland-based W.R. Grace, declined to comment on the bankruptcy case or the criminal prosecution, citing an order by the trial judge limiting what the parties can say publicly.

Grace is charged with conspiracy, violating the U.S. Clean Air Act and obstruction of justice. The six men face between five and 15 years in prison if convicted on the counts they each face. Grace and the former executives have all pleaded not guilty.

Reorganization Plan
Grace said in a Nov. 7 U.S. Securities and Exchange Commission filing that it spent $108.3 million through September defending the case. The company said it may be forced to pay a $280 million fine if convicted, according to SEC filings.

Grace sought court protection in 2001 in U.S. Bankruptcy Court in Wilmington, Delaware, in response to more than 100,000 asbestos claims. Since then, the company has fought with asbestos lawyers and creditors over how best to set up the trust to compensate people damaged by the company’s products. Last year, it settled on the outlines of the trust.

Grace told the SEC it may need to borrow as much as $1.5 billion to help fund the $2.4 billion asbestos trust and to pay other creditors owed more than $1.5 billion.

The company’s reorganization plan would need to be rewritten should a large criminal fine be levied, since the proposal does not currently provide any money to pay such a penalty, according to bankruptcy court records.

Shareholders would be disappointed should a large fine delay Grace’s plan to exit bankruptcy later this year, an analyst said.

“They don’t want to operate in bankruptcy any longer than they have to,” said Dan Natoli, a senior analyst with Matrix USA LLC. Natoli recommends selling Grace shares and doesn’t hold any.

1,200 People
Prosecutors claim 1,200 people were injured or killed in the Libby area. The government alleged that many workers and residents of the town are dead or dying from asbestos-related diseases, including asbestosis, a scarring of the lungs, and mesothelioma, a fatal cancer.

A grand jury in 2005 indicted Grace and seven current and former executives for allegedly conspiring to release asbestos- filled vermiculite in Libby and then covering up the dangers.
Grace mined and processed vermiculite, a mineral used in fireproofing, insulation and potting soil, outside Libby from 1963 to 1990, the company says on its Web site.

Prosecutors said workers brought asbestos into their homes on their clothing. Other people were exposed to asbestos when they used vermiculite for gardens or as paving material on their driveways, they claim.

Children Exposed
At a hearing last month, a toxicologist for the U.S. Environmental Protection Agency testified that children swung on a rope and dropped into piles of asbestos-filled vermiculite at the Grace mine’s export plant. They ran on the material at the high school track and played on it in ball fields.

The individual defendants are William McCaig, former manager of operations at the Libby mine; Robert Walsh and Robert Bettacchi, former presidents of Grace’s construction products division; Jack Wolter, ex-general manager of the construction products division; and Henry Eschenbach, a former director of health and safety.

Grace is paying their defense costs, the company said in a regulatory filing. Former Grace legal counsel Mario Favorito will be tried separately beginning in September 2009. A seventh man charged in the case, Alan Stringer, a former general manager of operations in Libby, died in 2007.

No Comparable Prosecution
“There’s no environmental prosecution that is comparable to the Grace case in its scale and complexity,” said David Uhlmann, formerly the Justice Department’s top environmental crimes prosecutor and now a professor at the University of Michigan Law School. As chief of the Justice Department’s Environmental Crimes Section, he led the team that investigated and sought the indictment of Grace.

“It is unquestionably the most significant criminal prosecution” the U.S. has filed against an alleged corporate polluter, Uhlmann said.

U.S. District Judge Donald Molloy, who is overseeing the case, has said the trial may take as long as four months.

Missoula is a 3 1/2-hour drive from Libby, which is on the Kootenai River in the northwest corner of the state.

Uhlmann said the length of the alleged conspiracy, the large number of people killed and sickened and the fact that senior Grace officials were charged, including several who worked in the company’s Maryland headquarters, makes the case unique.

Two Year Delay
The case comes to trial after a delay of more than two years while prosecutors appealed a series of unfavorable pretrial rulings to the U.S. Court of Appeals in San Francisco.

In September 2007, that court, which has jurisdiction over Montana federal district courts, reinstated a key conspiracy claim against the defendants, reversing a ruling by Molloy. Grace shares dropped 5.5 percent in response.

Molloy entered a series of orders designed to avoid local anger over Libby from affecting the trial. For example, prosecutors may not refer to “victims” in their opening statement.

The judge also declined to characterize 34 government witnesses who claim asbestos exposure as victims for purposes of the Crime Victims’ Rights Act. The decision means those witnesses won’t be allowed in court during other victims’ testimony.

“If you’re a victim of a rape or a robbery and you survive it, you get to have your day in court and face your offenders,” said Gayla Benefield, an advocate for asbestos victims who has lived in Libby all her life. “A lot of Libby residents won’t get that chance.”

Benefield, a miner’s daughter whose parents both died of asbestosis, has also been diagnosed with the disease.

The case is U.S. v. Grace, 05-CR-00007, U.S. District Court for the District of Montana (Missoula).

Dissatisfaction over investigations into alleged rapes has prompted a number of North Lincoln County residents to consider a recall of the sheriff.
Organizers promise a petition to that effect.

If one is actually circulated, other residents would do well not to sign it for two reasons.
First, there is no sufficient legal grounds to recall the sheriff.

Second, and more importantly, a recall solves nothing.

Montana is one of 17 states that allow citizens an avenue for removing elected officials from office. But that power is limited. State law allows recall of an elected official for lack of physical or mental fitness, incompetence, violation of oath of office, official misconduct, or conviction of a felony offense.

None of these in fact apply to Sheriff Daryl Anderson.

The law that subjects Anderson and every other elected official to recall specifically states: "A person may not be recalled for performing a mandatory duty of the office that the person holds or for not performing any act that, if performed, would subject the person to prosecution for official misconduct."

It's one thing to disagree with the sheriff on decisions he makes. We certainly have had occasion to do so. But it's quite another to allege misconduct and incompetence when neither apply.

A recall is therefore inappropriate.

And recalling the sheriff solves nothing. Implementing a public affairs protocol would.

We've pointed out in the past that the sheriff's department in Libby sorely needs a trained liaison to deal with the public, which has every right to raise questions and expect answers.

The tempest brewing over these investigations is another case in point of failed communication.

It can be done right. Officers right here in North Lincoln County are evidence of professional, courteous communication.

Equal treatment from Libby solves a problem.

Backing a doomed recall of the sheriff does not.

Lincoln County knows full well from a former justice of the peace in Libby that elected officials must on occasion be removed from office. " Unquote...

Judicial Accountability - Montana’s Best Known Oxymoron - Victims are not Victims until the Legal System Decides there is "actually" a Crime

I can say that for me, I have not seen a whole lot of justice in Montana.

My experience comes from trying to save a Child who is now a teen, from a Meth House in Libby Montana. My experience is with Drug Dealers that up until a few days ago, due to an injury, have been driving the school bus in Eureka.

In Eureka my whole adult life the local drug dealers are known, cops know, we all know and you are either a buyer, a friend or you just ignore it. It is a life that lives right along everyone else. And folks I am not talking about Marijuana.

I am talking about Meth (the modern meth that is more toxic then ever), I am talking about Crank, Cocaine, Herione, Ketamine, and modern drugs that some of the drugs men and women take willingly that put them out for hours. Date Rape drugs are alive and well in Eureka Montana. Drug dealers drive with no insurance and almost killed a long time residents about a year ago, this one got a $30 fine from the local JP.

In High School, the feared the cops, due to sexual advances. I have seen robberies unsolved year after year unless someone in the public solves them. In the late 70’s the Rumor mill was buzzing, yes I was young, but adults do have their rap sessions in ear shot of children, I am unsure the details I just remember a Highway Patrolman was shot, and nobody understood or seem to believe the “official” story.

At this point all folklore and myth I suppose. But Lincoln County sure has a lot of it, growing up here I just thought stories of Drug Planes, People Disappearing, and mysterious crimes and all that went with it was rumor and speculation, I guess we will never really know the truth about those days. But today it is our world and your children are living in an entirely different Lincoln County Montana.

In the last 10 or 15 years it has been quite shocking, from my perspective, from my point of view, all the crimes that has happened here and the blatant ignoring of it.

Cars stolen and found in other States months later. Trespassing is Rampant, Some local hunters even take groups of hunters onto private property, passed the No Trespassing in hunting season and not. Call the game warden, first he says take a photo of them, then he'll say well that photo could have been taken anywhere. Hunters driving by houses shooting at them, the owner of the property mad because of the Blatant Trespass and so his payback is sugar in the tank of his heavy equipment, his house ramsacked, his studio painted with grafati, and no one ever prosecuted. These stories are truly endless.

Some Cattle owners remove fencing to let herds of cattle on to private property. The creeks are full of cattle and nobody really seems to be able to tell a land baron to STOP their illegal and immoral behavior. But threaten to kill a cow and the Brand Inspector threatens prison.

Corporations, such as Tungsten Holdings, get to open up long forgotten roads across private property, the people fight, the Big Shot Realtor and their Developer wins over the People of the Tobacco Valley pretty much every time.

They have public meetings to comply with state law, about Developments, Growth Plans and other things they have to by law, but the thing is the Public is NOT listened to and they eventually give up and have not voice. Then they are accused of, well you did not come to the meeting so we did it our way. We all know full well that “they” do it their way anyway.

Real Estate Fraud is alive and Well and seemingly legal, for their is No accountability if a Realtor flat out lies. Mortgage Fraud is VERY legal here, the JP, the Cops, the Dept. of Justice, the FBI, the Montana Banking Division they don't care, they have blatant .. without a doubt proof and solid leads and they ignore consumer distress in Lincoln County Montana.

We all just duck and cover and wait for it to pass. We have all lost total faith in the Police or the Judicial System helping with anything really at all. That being said, there are some local cops here in Eureka that are very good people and really want to do a good job, but I believe that they run up against a brick wall when it comes to actual punishment and some probably just give up.

Some cops leave such as “Robo Cop”, the cop that shot Jerry of Jerry’s Saloon, the Cop that use to sit up at TJ’s bar and use his breathilizer to entertain women.

I have had Real Estate Clients move here to Rescue their kids from big city crime only to have them die on the floor of a Lincoln County House Party. We are in trouble and if you folks really want Eureka to be your home, now is the Time to Stand up and Speak Your Mind.

I don’t’ know what is really going on. I don’t know what you folks are seeing in your corner of Montana, your “Neck of the Woods” But I want you to know that Internet Marketing is what we do and I ask you where ever you are reading this to please write on our blogs and get your story heard.

Folks in Montana Right now people are being murdered and it is called a suicide, rape is seeming to some as legal, real estate fraud and deliberate mortgage fraud is running rampant with no accountability. People are losing jobs and homes and yet they paid into the system their whole life and this system is letting their family, their fellow citizens die in unmarked graves, suffer like the WR Grace Victims, Serial Rapes with no end in site, and some have lost complete hope that they will ever get justice for the crimes done to them or to someone they love dearly.

What if Your Home was Robbed in Lincoln County Montana

Say your home is Robbed, the Jewelry taken from the Jewelry Box, fingerprints on the wall and the Jewelry box and the local investigators, police say take it to Missoula to be fingerprinted.

Police tell the "victim" that cannot be called a victim in Montana until there is a crime that is determined to have really happened by the courts, they tell this homeowner (Lincoln County Taxpayer to actually take their own jewerly box and their wall Missoula Montana if they want it fingerprinted.

This is actually happening to VICTIMS of Lincoln County, and now the Libby Police will be under County Police authority as well. There is no end in site to the Lawlessness in Lincoln County Montana. I was emailed by a young gal the other day, in her mid 20’s. She says we don’t need another golf course we need places for the teens to “hang out” and something for them to do. This is VERY true, and why has Eureka Montana, Lincoln County not spend some off there extremely large monthly budget on doing something that would directly benefit the local teens.

It may Just be the Most Important Money this County could ever spend on anything, I mean, think about this and all that it implies.

That when she was 16, she was drugged and raped, and she became pregnant from this rape, it would be about 10 years ago, and that she and her mom at the time were told by the Eureka Police that she should not have been drinking. Funny how times don’t really change and if you have a drink that your panties and your pants instantly dissolve and your legs are uncontrollable stuck open. One Drink, any drink and you were just asking to be raped.

That Domestic Violence and children’s abuse is alive and well here now as much as ever and that more needs to be done about it. It seems there is no corner that is untouched by the lack of accountability for Bad Actions, Violence, Rape, Drugs and Crime in Lincoln County.

You folks are getting a chance for a better County, it is not up to me, it is up to you. You are being given a chance Right Now with the Lincoln County Recall to demand that your children have rights, that your friends and neighbors are heard and that animals beaten to death and hung, dropping still alive to their death is not what Lincoln County, not What Eureka Montana Stands For.

No matter what name you have, it is time to make your stand. Time to draw a line in the sand and to Push Back. It is time, Right now to come down off that proverbial fence and pick a side.

You, our forefathers and foremothers, this could not have been the Eureka you wanted and that you worked so hard to build. Stand up now and when the petition comes to your door, Make your Voice Heard. Not in Our Town. Not on Our Watch.

Give these young folks hope, reach a hand out to those sitting in the dark corners of our great county and say I am listening and you matter. We, as a community, no matter what name or lifestyle we have, no matter how much money we have or who we pray to, we now have a chance for change. And no there will not be a miracle but you will finally have a say, and I know most of you would NEVER let this kind of stuff happen if you were truly in charge.

Your good people you’re the kind of people that will fight for years over water rights but if that same person had a flat tire in freezing temperatures you lend a hand, and if they run out of gas you pick them up. Your not about to let people suffer even if you disagree with everything they believe, all they stand for and everything that comes out of their mouth.

So why let this stuff keep happening, just because it is not in your face does not make it any less real. This is your County, You Support it with your Blood, Sweat and Tears and you always have.

What Exactly is a Flap ? How many Sexual Assaults do you know of in Eureka over the last 5 Years ? You are treated as Mushrooms.

Your County Officials use the word Flap apparently about all these alleged rapes. So you have been raped by a gang of men and even after 10 victims come forward, the headlines read of flap.. Ashamed to Live here ? It does not get much more disrespectful to Lincoln County Victims.

What Should Your County do with $400,000 - oh I know, let's encourage Lawn Watering...

City ponders how to best spend water budget funds (hmmm.. I can hear the head scratching now)

Libby City Council members are torn on how to spend water budget money received from International Paper Co. – repair major water leaks, provide financial relief to city water users, reduce debt owed on the water system or a combination of the three.

The council mulled over ideas during Monday’s meeting.Using city water instead of well water to irrigate lawns strains the city’s water system and adds to residents’ metered water cost, the council said.Council members agreed at the meeting that it was important to give residents some amount of money off of their water bill to encourage green lawns in the summer.

At the same time, debt reduction and infrastructure needs are pressing.

Dan Thede, supervisor of city services, gave councilmembers a map indicating locations of the city’s major water infrastructure problems.“

These are ones we’ve been having continual problems with,” he said at the meeting, “but this is just the tip of the iceberg.”

The issue was sent to the water committee, which will further investigate and make suggestions on distributing the money.International Paper Co. gave the City of Libby $400,000 at the end of December to offset costs of lawn irrigation.

The company’s predecessor leaked thousands of gallons of creosote into the ground, contaminating water under the city. Residents are prohibited from using well water until the site is cleaned.

Troy Mine sued for millions over death in 2007

Revett Minerals – the parent company of Troy Mine – was served with a multi-million dollar lawsuit last week stemming from the death of a worker during the summer of 2007.Michael E. Ivins, a 55-year-old Libby man, died on July 30, 2007 when a rock roof collapsed onto his truck. The Mine Safety and Health Administration determined that Ivins was killed instantly.

The lawsuit seeks $8 million in compensatory damages and $10 million in punitive damages.Carson Rife, vice president of operations who works out of Revett’s office in Spokane Valley, Wash., said he did not have information available to him but assumed the Ivins family filed the lawsuit.

“Our attorneys are reviewing the complaint and the lawsuit,” Rife said Tuesday afternoon. “The company plans to defend itself against this action.”A message left at the home of Tammy Ivins in Libby was not returned before presstime.

According to a legal update issued through a press release, the lawsuit was filed on June 20, 2008 and served last week.“The action alleges causes of action based on negligence, failure to provide a safe place to work, strict liability for abnormally dangerous activity and intentional and malicious acts …,” Revett reports in the release.

The Troy Mine has been fighting to keep its head above water financially in the face of falling metal prices and poor economic conditions. The mine employs approximately 185 workers.Following an investigation, a report by MSHA determined that “the mine operator had knowledge of the unstable ground conditions in the area where the accident occurred.” As a result, the report concluded that Troy Mine management was at fault for the rock fall.In response to MSHA’s conclusion, Troy Mine General Manager Doug Miller said at the time that the company disagreed with the report.
