HR 2749 - Food Bill 2749 Passes House

A new food safety bill is on the fast track in Congress-HR 2749, the Food Safety Enhancement Act of 2009. The bill needs to be stopped. HR 2749 gives FDA tremendous power while significantly diminishing existing judicial restraints on actions taken by the agency. The bill would impose a one-size-fits-all regulatory scheme on small farms and local artisanal producers; and it would disproportionately impact their operations for the worse.

HR 2749 does not address underlying causes of food safety problems such as industrial agriculture practices and the consolidation of our food supply. The industrial food system and food imports are badly in need of effective regulation, but the bill does not specifically direct regulation or resources to these areas.

Is the Town of Eureka Montana a Commission-Executive Form of Government

On the Topic of a Mayor as the Chief of Police

The mayor, not the chief of police, is the chief law enforcement administrator in a commission-executive form of local government.

The term "chief law enforcement administrator" appears in several statutory provisions of the Montana Code, but nowhere is the term defined by law. See Mont. Code Ann. §§ 7-1-4144, 7-2-216 to -219, 7-32-221, 7-32-231. The majority of these statutes referencing a "chief law enforcement administrator" deal with the service of reserve and auxiliary peace officers as those terms are defined in Mont. Code Ann. § 7-32-201(1), (5).

Pursuant to Mont. Code Ann. § 7-32-216, a reserve officer may serve as a peace officer "only on the orders and at the direction of the chief law enforcement administrator of the local government."

A reserve officer may not carry a weapon while on assigned duty until authorized by the chief law enforcement administrator. Mont. Code Ann. § 7-32-217.

As soon as the reserve officer is appointed by the chief law enforcement administrator, he or she is vested with the same powers, rights, privileges, obligations, and duties as any other peace officer of this state. Mont. Code Ann. § 7-32-218.

Reserve officers serve at the pleasure of the chief law enforcement administrator and may be terminated by the administrator at any time.

Mont. Code Ann. § 7-32-221. The chief law enforcement administrator is obligated to appoint a full-time law enforcement officer of the agency as a reserve force coordinator. Mont. Code Ann. § 7-32-219. Finally, Mont. Code Ann. § 7-32-231 directs that a local government may authorize auxiliary officers "only on the orders and at the direction of the chief law enforcement administrator of the local government."

Your question is whether, in a commission-executive form of local government, the foregoing duties are performed by the mayor or the chief of police. After comparing the respective positions, I conclude that the mayor is the chief law enforcement administrator in a commission-executive form of local government.

In the commission-executive form of government, the mayor is designated the chief executive officer of the city or town. Mont. Code Ann. § 7-3-201. In that role, the mayor is responsible for the day-to-day administration of the affairs of the municipality. Mont. Code Ann. § 7-3-203.

The mayor also has general administrative and supervisory authority over the local police department. Mont. Code Ann. § 7-32-4103. The mayor is given the power to appoint all members and officers of the department, as well as the power to suspend or remove any member or officer on the force. Mont. Code Ann. §§ 7-32-4103, -4108. All members of the police force are appointed for probationary terms, subject to revocation by the mayor. Mont. Code Ann. § 7-2-4113(1).

The mayor is responsible for making rules for the government, direction, management, and discipline of the police force. Mont. Code Ann. § 7-32-4103. Whenever the mayor deems temporary employment expedient for the police department, he or she has the authority to employ temporary assistance. Mont. Code Ann. § 7-32-4109.

The chief of police, on the other hand, is given charge and control of all police officers, but has no responsibility in connection with hiring and terminating officers or setting rules and regulations for the department. Mont. Code Ann. § 7-32-4105(1)(c). The chief has the same powers as a constable in the discharge of his or her duties. Mont. Code Ann. § 7-32-4105(2). The constable's duties are defined under certain provisions relating to the duties of a sheriff.

See Mont. Code Ann. § 3-10-702. None of those sections provide authority for the chief of police to hire or fire officers or employees, or to make rules relating to the government, direction, management, or discipline of the police force. The chief's only duty in relation to the officers is to report neglect of duty or misconduct of officers to the council for its action. Mont. Code Ann. § 7-32-4105.

In light of these respective duties, I conclude that the mayor is the "chief law enforcement administrator" in a council-executive form of local government. The mayor is statutorily vested with responsibilities similar to those of the chief law enforcement administrator, while the chief of police is not. To bestow the title of chief law enforcement administrator upon the chief of police would require the chief to perform administrative functions which he or she is not otherwise authorized to do.

THEREFORE, IT IS MY OPINION:
The mayor, not the chief of police, is the chief law enforcement administrator
in a commission-executive form of local government.

Is it Illegal to Be the Chief of Police if you Did not Go to the Police Academy?

Who can file charges against a Mayor that says they are the Chief of Police and One Year and One Day and a whole lot more has past and the Mayor had NOT went to the Police Academy. Is this against the Montana Codes?

Can You File under the Criminal Code? Can you press Criminal Charges? If a Mayor is the Chief of Police and has not went to the Police Academy, know the laws the police must abide by or be able to enforce those laws then does this not put the Tax Paying Citizens of Eureka Montana at Risk?

I guess other Small Towns do this, I know that Eureka has for quite some time, what I don't get is how can a guy with no police experience, certification or training of any kind be the Police Chief, just because he is the Mayor?

Having a few drinks at home on your off time is not against the law. Having a fight, verbally with your spouse is not against the law. Having your spouse threaten suicide is not against the law, asking for help is what your are suppose to do in these situations.

But not here in Eureka and not by me.

I have never claimed to be perfect, I never said I should not get in any trouble over all that, I used poor judgement in that I had a few drinks, oh well who hasn't used poor judgement when they have had a couple of cocktails, I do however feel the punishment was extreme, and why should I fear losing my job, my home, my everything due to it?

Should I have called everyone's boss who I have ever seen in the bars and tell on them.

Should I call everyone out that has ever bought a 6 pack at the store and tell their friends, family, employer that they bought a 6 pack?

How many times have I drove people home when they have been drinking, how many people have I stopped from getting in there car when leaving the bar and kept them from making a mistake, kept them out of trouble or from hurting themselves?

This case is over I was not charged with a crime. I did not violate any laws or policies. I have gotten my punishment I was required to get an alcohol evaluation. Guess what I did.

I was off for 2 weeks with out pay holly crap better call my bank and let them know I am late on my bills now. I am appealing the city's ruling on the bases of the punishment being unfair. That case is over now and we are on to the next issue.

Here it is...

I am being charged with privacy in communications under Montana code. I have appeared in court plead not guilty and asked for a jury trail.

I always thought you are innocent until proven guilty. Maybe I have been wrong all this time.

I don't know, but that's how I have always treated people. This Current issue has to do with my teenage son rebelling against me and my rules. Anyone who has had a teenager at some point is going to have a similiar problem.

Any mother whose son takes off, don't come home, isn't obeying the rules, isn't fulfilling their responsibilities, isn't acting normal.... or is just plain acting out..... would have been feeling the same way as I did.

If I did not say or do anything wouldn't that be worse then calling the kid out. I do not agree with my son's actions or choices right now, I do not agree with a mother of a 16 year old high school girl allowing an almost 19 year old boy, my son, to be staying there with the 16 year old girlfriend. I do not think I am out of line. What is going on is malicious prosecution.

I did not violate the law in calling my son and demanding he behave. I did not violate the law in asking my son to come home and follow the rules, I did not violate the law by trying to parent my child.

If this is a violation of the law, be careful what you say to your children, if you text them or tell them over the phone to get your ass home, you may be arrested, or charged with a crime.

Anyway that's my story. I am sure the paper, the mayor and the rumor mill will say something totally different then that. If anyone would like to know the truth I am easy to find.

No they ticket, harass and set up people that are not fitting into the “Code Blue Of Silence”. they do this to anyone of you who stand up for your Montana Victims Rights or call them on their bad behavior.

Cops go to school 12 weeks in Montana and then they get to Make or Break your life, they get Free Reign to Ruin your life and no one Cares, no one believes, no one is paying attention and no has the power to do anything about it yet YOU pay their wages.

"Bubba" for Mayor ? I don't think soooo.. No Way. - Accountability and Transparency is Demanded..

"Bubba" they call him, he is a fun guy, he is a sweet guy, love his taste in trucks. "Bubba" is too young, to inexperienced, and most likely will NOT be able to stand up to what Mary Duram and the Boys are going to throw his way.

Being Mayor Should Not be about How Many Relatives you have. It should have a Bigger Qualification then just be 18 and a Resident of Town for 6 Months.

The Mayor is the BOSS of the Police.

Yet does not have to have ANY experience in law or even know the laws that apply. Who cares right, Mary Duram - the REAL Mayor, is always there to tell you what to do, say and think right? And we all know that Mary Duram is who makes the Decision for the Town of Eureka, though she is NOT a Resident of the Town of Eureka.

The Mayor decides your fate in a way, I mean if the local cops answer to the Mayor then the May had best have High Integrity, Transparency, Listen to All of Us whether we are in City Limits or Not, and be able to say NO when something is illegal or just not right. How can a Mayor do that if they have no law experience. It is like running for Mayor here is a High School Popularity Club. Yet this Affects your life on every level, the local cops go on calls to the High School, they are involved in your life in a Big Way YET you have no say if you don't live in town.

The Town's actions with YOUR money if you own in town but are not a resident is not something you even get a say in. The Mayor has got to Stand up for You and not cower at whatever the County or City Attorneys tell him. If the Mayor had some sort of Legal Training they would know if they are being lied to, mislead or somehow given false information that hurts the tax paying citizens of this whole area. But this is in NO WAY a Requirement.

Your Investments are Affected, You drive through town, you use businesses in town, your children go to school where town cops respond, you are AFFECTED by who the Mayor of Eureka Montana is. Yet YOU have NO SAY.

I love the Carvey Family, mean no disrespect. the Pearson folks are awesome, but Bubba Pearson is NOT right for the Position of Mayor in Eureka Montana.

He is possibly even just too much of a nice guy, a fun loving just plain ol' sweet guy. I have never heard a bad thing about this Nice Guy.

the Town of Eureka is in BIG trouble and needs someone with more Moxy, more experience that can stand up to what will INDEED be forced on them, asked of them and Demanded of them. And wishful thinking, but someone who actually knows Law, at least a little bit.

I went to Lake Koocanusa a Few days ago and there were folks of all ages lined along the beach to relax and swim. It was a weekday. Relaxing was Impossible because Your New Mayor Candidate was blasting music to his taste, so loud you could here it around every cove, and it was quite impossible to get away from.

Oh well, this happens. However, a bit to immature, not thoughtful of others, not experienced in what it will take to Stand up to What WILL be asked of him - demanded of him at the Council Meetings and all parts of this job.

THE Mayor is the BOSS of the Police, and they probably do want him as Mayor so they can push him, talk him into doing what ever they want. Many are already scared of being pulled over by a local cop and what they will do to them. If the Mayor is a push over or easily manipulated it will have gone from bad to worse. Why have a Mayor if the Police Run them, and if Mary Duram .. the Lifelong Secretary Runs them? The only reason Eureka seems to have a Mayor is to abide by some federal law.

The Current MAYOR failed in getting Hundreds of thousands of dollars of money available to you, no one cared. He was not in the Know enough to even go for those Grants. A Mayor NEEDS to be up on available grants that benefit YOU .. and be Smart Enough to Go for them.. Remember how much of that FREE Money falling recently the Shelby Montana Mayor went for? Now there's a guy who cares and follows through.. with getting the bucks in place..

We shall hold anyone who votes for Bubba Pearson accountable for ALL .. and I mean every single action the Town of Eureka Makes, the Police Commission Makes, the City Planning, and every move the Local Cops make. If you vote for Bubba and he caves and does what they tell him to and this hurts the People of the Tobacco Valley.. well YOU will be accountable for his actions. It is that simple.

Though Bubba is a great guy, I do believe he will NOT have the experience behind him to stand up for what is right. I believe Mary Duram, who really runs the town will run him and easily.

How will Bubba even know what he doesn't know with these big scary cops, and the Town Queen telling him what he really should do?

Your New Mayor needs to have some SERIOUS backbone and experience.

the Town of Eureka, those who run the Town, they GET very mad when, who they want to get City Contracts don't get them, I have heard that Dave Newburn has stood up to this some. Though I am not real sure about Dave, I do not see a lot of Moxy there, but I do see glimpses of Integrity and Backbone.. but still Dave may be run around a bit by the REAL Mayor whose terms NEVER end (Mary Duram), and Dave may Cave with an Attorney pushing him around..

In my opinion "Bubba" will be easily manipulated and bought. Not to say he is corrupt in anyway, but to say he may not know how corrupt things can be. And once you step in as Mayor and See how bad it is... you had better be able to take the heat, and to do what is best for the Greatest Good of All.

July 16th - 2008 - Commissioner Meeting Minutes - they Know.. year after year and they DO NOTHING.

2:57 PM: Barb Guthneck: Barb and Cookie Haidle came to give an update about the Lincoln County Crisis Solutions and the things that have been happening this year. The Libby Schools are doing a great job in the tobacco prevention issue.

The Empowerment project is going on targeting respect and protect on rape issues and there are round services for victims. Only 2 have gone back to abusive relationships this past year. Forty-nine new people have been served in Eureka since January 1st. Lincoln County has seen 5 sexual assaults in 3 months in addition to 6 that did not report to the law. The Date Rape drug is in the Libby area. The ladies are asking the Commissioners for a letter of support to send with a grant application. Commissioner Windom indicated that they would be willing to do that.

i dont know much about this storie but i do live in eureka. i just wanted to comment on some of the comments on here.before all of you get upset at anyone that has anything negative ot say about this town make sure you know what is really going on around here.

this is the most messed up town i have ever lived in. one of the biggest drug dealers goes to our high school. the date rape drug is horrible here. the kids drinking it up and drugging out while the parents are at the bars drinking, city police officers bailing out men who were arrested for violating a restraining order, having crack pipes on him and other things in the school parking lot. yes a cop did that and she drove all the way to libby to bail him out.

there is sooooo much more then what i have listed but just not enough time to write it all. you cant depend on our police officers to do their job. they dont really care.

i also want to add that i heard that it is getting hard to find pot in this town as meth is the drug of choice.pretty sad if you ask me.

and one of those dealers hapens to be the son of a border patrol cop. so i guess it is safe to say that this town is messed up and to those who want to say it isnt possible,its a great town, or defend it, you better do some checking. it is all happening right under your noses. just ask the officer that has been seen buying cigs and alcohol for the minors.

...According to Cookie Haidle, a victim's advocate for Lincoln County Crisis Solutions, nine Eureka-area women have approached her since May 2008 alleging rape. A 10th woman was raped in early 2007, she said.

Five of the women Haidle is in contact with reported their alleged rape to law enforcement — either the Lincoln County Sheriff's Office or Eureka Police Department.

A sixth made a statement but later withdrew it. Four will not allow her to contact authorities.And Haidle, who is not associated with the recall petition, believes three of the alleged rapes were committed by the same group of people. Alcohol and date-rape drugs appear to be common elements."I feel the judgment was made that either they didn't believe a sexual assault happened... or they didn't think there was enough evidence to continue an investigation," Haidle said. "It's kind of like they're brushed off.

Excuses have been made."The most recent rape allegedly occurred on Jan. 12, Haidle said. A woman on a four-day methamphetamine bender was tied to a bed and possibly drugged. The woman refused a rape test because of other sexual activity, but did give a blood sample, Haidle said.

10:30 AM: Cookie Haidle, Crisis Solutions: October 15th 2008

There are 16 people from the public in attendance. Cookie stated that there have been 9 rapes in the Eureka area that Crisis Solutions is working on and 5 have been reported to law enforcement. Commissioner Konzen asked if Cookie Haidle thinks that the cases have a similar ring. She said that they do.

M.... has come to tell the story of what happened to her on June 26th. She feels that a drug was put in her drink and she was raped. She went to Kalispell Regional Hospital the next morning and called a detective to come to take pictures.

She read a letter that stated that she is frustrated and wants something done to these men. Cookie has four things to suggest to the Commissioners:

1) Offer counseling immediately to victims.

2) Hire a part time detective in Eureka.

3) Hire a part time prosecutor in Eureka. Cases are dismissed in Eureka because there is a failure to prosecute.

4) Bring in groups from around the State to train the law enforcement people to deal with rape kits and collecting evidence on these cases. The Commissioners read a letter that was faxed to them by Lori Haverty-Ramesz.

She suggests that options are available and they should keep the victims secret and train the public what to do in case of rape. Commissioner Konzen talked about where to go from here and he feels education of the public is the key. Commissioner Roose talked about forming an advisory committee. Cookie presented a plaque for Commissioner Windom in appreciation for her role in the crisis program’s beginning years ago.

The recall committee has attempted to provide us with an opportunity for change and yet now no one is willing to sign. The Town of Eurkea is SCREWED UP.. on many, many levels and no one with the "Audicity for Change" seems to be able to get into office. Seems like Planning Boards and other important positions are being filled by people that Marianne ROOSE can easily run around, out move, out manipulate and CONTROL. Law Enforcement on "Alert" for civil unrest

I received a call today from a friend with contacts in law enforcement. He told me that he had been informed that law enforcement in the states of Montana, Idaho and Oregon have been put on "alert" to watch for "civil unrest". No other details were given. Now if the Rapes did not Really happen, and all was REALLY investigated, well Cookie Haidle pulls the strings on whether the TRUTH about these Crimes is released or the LIES that Protect the Sheriff are the “Official” Story. What is Cookie Haidle getting from our year of Blood, Sweat, Tears and CONSTANT work on behalf of Lincoln County Victims that SHE, herself told us about????

Folks, how do you think I know the Supposed FACTS about these “Alleged” Rapes? How do we know that the iPod was given back to the Rapists, and the exact scenerio, which I wrote on my blog about, did a video about the Day Cookie Haidle Told me last Fall. And before the Infamous Council Meeting where Cookie Haidle took a Rape Victim to speak and to plea for justice.

In the Big Picture the only reason any of these folks know the details of these Crimes, these Rapes is Directly From North Lincoln County Lead Advocate for the Lincoln County Crisis Solutions Center, Cookie Haidle. And how do we know that they had evidence and did not prosecute? Again from Cookie Haidle and now she is laying us on the Tracks, How can a supposed Victims Advocate feel good about that.

Cookie brags Anderson up in saying he fufilled his promise of more detectives, police presence in North Lincoln County though she has been known to say the opposite. And a letter to the Editor in the TVN recently from a long time local gal spoke of police dispatch and what Anderson was doing with that being a step backwards in all that they had done to get the police presence that they have. Residents here know that it is NOT true that the Lincoln County Cops from Libby are here more and that Daryl Anderson has in no way "fufilled" any promises such as Cookie Haidle Says.
